Conditions of Use

1. General 1.1 These conditions of use prevail above any other possible conditions regarding offers, orders and agreements with Pokerspecialist. 2. Application 2.1 These terms of conditions are applying on all right relations in which Pokerspecialist is the supplier of the goods. 2.2 Accepting an offer or making an order means that you are accepting the terms and conditions from Pokerspecialist. 3. Promotional offers 3.1 All promotional offers by Pokerspecialist are without engagement. Promotional offers occur subject to availability. Pokerspecialist has the right to supply a similar product to the one that has been ordered or to terminate the agreement. Mistakes in prices are always on reserve. 3.2 Pokerspecialist explicitly preserves the right to modify the prices, in particular when this is necessary because of legal regulations. See also article 5.3. 3.3 After the fence date of an offer or action period it is not possible for the buyer to use the particular action or offer. 4. Agreement 4.1 The sale agreement between Pokerspecialist and the buyer is finalised after the end of the period in which the buyer can have the product(s) on a trial basis. This is because of Dutch law after seven (7) working days. 4.2 An agreement only comes about after being accepted by Pokerspecialist. Pokerspecialist has the right to decline orders and/or to have certain conditions on the order. If an order is refused then Pokerspecialist will let this know within ten (10) working days after the order was made. 4.3 Pokerspecialist is located in the Netherlands. Therefor Dutch law applies. 5. Price and delivery 5.1 All prices are including Dutch VAT, unless otherwise agreed on, excluding other taxes that are put by the Dutch government (if applicable) and other costs, such as costs for shipping and administration. If the buyer is not residing in the country of shipping then the buyer is responsible for VAT and import duties (if applicable). 5.2 Prices are including the standard package and excluding shipping costs, or it should be agreed on otherwise. 5.3 If the prices of the offered products and services increase in the period between ordering and delivering, then you have the right to cancel the order. 5.4 Pokerspecialist cannot be held responsible for differences in prices, images and texts. 5.5 Pokerspecialist has the right to deliver the order in more than one consignment. 5.6 Pokerspecialist strives to deliver all the ordered products within seven (7) working days on the stated delivery address with the restraints that the products are paid and in stock. 5.7 The delivery times stated above are an indication and are not the last possible amount of delivery days. Pokerspecialist is never to be held responsible for damage due to extended delivery times. The maximum delivery time is 30 days unless otherwise agreed on. 5.8 Pokerspecialist chooses the way that the products will be delivered. 5.9 The ownership of the products changes when they are delivered and the products have to be paid. 5.10 Deliveries are always be put till over the first doorstep of the ground floor. The person delivering the product(s) is responsible for deciding if the product(s) will be delivered further than the first doorstep. Deliveries on other floor levels than the ground floor are only possible if the product(s) fit in the in-house elevator and if there are no further obstacles. The purchaser has to check if the delivery fits in the elevator and has to tell this when ordering. The person delivering the product(s) will make the decision if the product(s) will be delivered on other floor levels. There is only an obligation for delivering over the first doorstep. 5.11 The buyer has to accept the purchased product(s) when they are being delivered or when he is notified where he can get them. If the buyer refuses to accept the delivery or is neglecting with giving information or instructions (which are needed for a succesfull delivery) then the goods will be stored with the buyer bearing the risk and Pokerspecialist will charge additional costs. 6. Delivery costs of the products 6.1 All prices of the products on the websites of Pokerspecialist are without the costs of delivery. When ordering the real shipping costs will be shown. 7. Returning products 7.1 Products that you bought at Pokerspecialist can be returned without notifying the reason withing seven (7) working days after receiving the product(s), only if the products are not used and are put in the original packing. The buyer can withdraw the order within seven (7) working days without having to pay a fine or without stating a reason. Only if paid enough for the returned goods in terms of shipping costs. The buyer then also has the possibility of getting the amount for the products paid back (if the buyer already has paid it). You then need to contact poker@pokerspecialist.net within seven (7) working days after receiving the product(s). 7.2 When you receive a product with an error, then Pokerspecialist will return the product for no charge for exact the same product, only if the product is not used and is in the original package, unless the product is not in stock anymore or "end of life". The buyer has the right to get the paid order amount back. The buyer needs to contact poker@pokerspecialist.net within seven (7) working days after receiving the product(s). 7.3 If you receive a product other than the one you ordered, then Pokerspecialist will change the product at no costs, but only if the purchase has not been used and is still in the original package. The buyer has the right to receive the money back (if already paid). Please contact poker@pokerspecialist.net about this within seven (7) working days. 7.4 If you are allowed to return the product, then the paid amount will be paid back within forteen (14) days. You always have to contact poker@pokerspecialist.net about this. 7.5 If the above terms are not respected by the purchaser, then the purchasers rights are forfait. 8. Complaints, investigations, to be prescribed, to comply 8.1 Complaining about non-received products should be done within seven (7) days after receiving the invoice, otherwise the invoice is accepted as being correct. 8.2 Complaining about broken or incomplete products should be done in writing and not later than seven (7) days after receiving the products. 8.3 You have the duty to investigate at the arrival of the goods if they are according to the agreement. If this is not the case then you have to inform Pokerspecialist in writing and not later than seven (7) days after the arrival of the goods. If it is proven that the products are not as agreed on, then you can choose to either return them and receive the correct ones, or return them and get that part of the money back. If you do not want to keep a product (for whatever reason) then you can return it within seven (7) days after it has been delivered. Returned goods are only accepted if they are undamaged. Costs for returning the products are for the customer 9. Liability 9.1 Pokerspecialist does not accept any liability due to (or indirect due to) the execution of the agreement, the delivery of the goods, except in case of doing it ourselves, or when it was a risk that damage would occur. 10. Dutch text prevails 10.1 The Dutch text of these conditions prevails above all translations. 11. Changing these terms 11.1 These terms can always and without notification being changed by Pokerspecialist. The changes will occur on the website(s) of Pokerspecialist. The changes will go into effect forteen (14) days after the day the changes were made public.
